The Legal Aspect Of Spam

Spam is flooding of the Internet with unsolicited bulk messages. It is illegal and unauthorized. It is abuse of the electronic messaging system. The most widely discussed spam is e-mail spam. Other forms of spam have also been reported like the spam in blogs and spam in mobile phone messaging. Stealing Internet mailing list and searching the web for addresses and using that information for spamming is also very common.
Everyday we use to see a large number of junk mails in our mailbox invading our privacy, wasting our time and crowding and confusing our mail boxes. Internet users who have measured phone services, end up spending more money because of spam emails. Spam also costs the Internet Service Provider for transferring the message to the individual Internet user who in turn transmits the cost to the customer.
US Safe Web Act of 2005 (S.1608) has given more powers to the Federal Trade Commission to enhance enforcement of law against spam, spyware and cross border fraud and deception. The Anti-Phishing Act of 2005 (S.472) provides a safeguard against Internet scams which are involved in deceptively obtaining personal information. These scams are known as phishing and are legally considered as a crime. The law also punishes the website which pretends to provide genuine online business when in fact it is swindling and cheating Internet users. .
American people are increasingly using the Internet for various purposes like banking, commerce, communication and entertainment. Therefore, Internet communications must be genuine, authentic and traceable. Spam leading to frauds and financial loss should be treated as a crime and dealt with as per law. It is an ethical and moral responsibility to fight Spam and be responsible for making the Internet useful, safe and reliable.
